If a program is not aired for reasons of: 1. telethon, 2. station carelessness, or 3. tecnical malfunction(s), the station shall provide "make-up" time for the programs not aired. C. The Station reserves the right to take 30 seconds per 30 minutes of air-time for station identification or disclaimer per program. D. The Station must advise client(s) of any scheduled program changes that may effect their program times; and must re-schedule. E. If the client fails to call or appear for a scheduled program, and NO stand-by tape is available, the station will use other programming to fill the slot, at it's discretion. The client will be charged for the slot of time. F. The client must inform the station of termination of this agreement at least four weeks in advance and in writing. G. This station will not tolerate programs with adult content. No racial slurs, or inflamatory remarks are to be used during your time of broadcasting. A letter of warning will be issued for the first offense. For the second offense, your broadcast time will be revoked, and (NO) refund of broadcast fees will be paid back to you. If the station is fined by the F.C.C. or any other law agency, all fines levied on the Station shall be passed on to the Client for payment. H. The Station must provide in writing, of any format changes which may cause termination of their programs at least Four (4) weeks in advance. I. On month-to-month contracts, monthly payments ar due by the 10th of every month. A 10% surcharge fee will be added for each payment that is past the due date. J. The station will be closed for the following holidays and will be automated for these days: New-Year's Day, Memorial Day, The Fourth Of July, Labor Day, And Christmas Day. We require a cd of your broadcast to put into automation. If none, a substitute will take your slot. K. If a disagreement or disbute arises, requiring court intervention, a court within the State of Massachusetts shall hear the matter and render its decision. The client shall, unless decided by a judge, pay all court costs.
